Guidance has been issued on undertaking emergency procurements using clause 4 of the Public Works and Procurement Regulation 2019.

Clause 4 of the Public Works and Procurement Regulation 2019 allows the head of an agency or their nominee, in an emergency situation, to authorise procurements to a value sufficient to meet the immediate needs of that particular emergency.

Such procurements are exempt from section 176 of the Public Works and Procurement Act 1912 (PWP Act). This means that, amongst other things, you do not have to comply with the policies or directions of the Procurement Board. This allows you to undertake expedited procurement during the emergency.
